Legal Information

The brand Isidore Leroy belongs to the S.A. CII Participations, 113 rue de la Benauge 33100 Bordeaux (FRANCE), also referred to hereinafter as "Isidore Leroy" or "the seller".

The seller has set up a website for the sale of decoration products to which the General Terms and Conditions of Sale (GTC) apply, for the sale to individual customers (here referred to as "individual customers") and to professional customers (here referred to as "professionals").The placing of an order implies the acceptance of these General Terms and Conditions of Sale.

The seller may, if it sees fit, modify the General Terms and Conditions of Sale, all orders placed under the former terms and conditions will be governed by them.

Products

Each product is presented with its technical characteristics and under a unique reference.

Photos are subject to change at the discretion of the Company. The colors of the photos are not contractual and may not correspond to the samples sent. The Company cannot be held responsible for these differences due to the quality of the screens or the different batches of the products.

 

Orders

Each order will be subject to acceptance of the general conditions of sale.

An order to be valid, must be paid in full, in advance by means of one of the various solutions offered online or by check. And correctly filled in the form displayed on the site, the buyer must imperatively provide a valid billing and delivery address, an email and phone number. The order confirmations are sent by email to the address indicated by the customer in his orderThe date of the order is the date of validation.
All orders placed on weekends (from Friday 12:00pm to Monday 9:00am UTC+2) will be validated on Tuesday at the latest. All orders received in the morning and validated will be processed within 48 hours for the shortest possible delivery time.

Orders can be cancelled by contacting our customer service until the products are shipped, except for personalised products for which, in case of cancellation of the order by the customer, an indemnity equal to or greater than 50% will be retained and will be increased to 100% of the price when the products have been specially made for the customer. In case of cancellation with partial refund, the refund will be made within one month after the acceptance of the cancellation by the seller.

 

Delivery

The seller will not be held responsible for a wrong delivery address indicated by the Customer.

In this case, after a period of 3 months, the products will be put back on sale and the payment kept by the seller.

The products returned to the seller for delivery error or absence of the recipient will be sent again at the exclusive expense of the customer.

Any delivery date indicated or agreed upon is for information purposes only and is not binding on the Seller. A delay in the delivery date does not give the Customer any right to compensation or cancellation of the sale, nor does it release the Customer from any obligation to accept or pay for the goods.

Returns

Isidore Leroy offers to the private customers a right of return or withdrawal of 14 days. Individual customers have fourteen days from the date of delivery of their order to return the product to the seller for exchange or refund without penalty. The return fees will be at the purchaser sole expense.

This possibility does not apply to products that have been cut or tailored by the purchaser, even partially, are excluded from the right of withdrawal.

Warranty - Claims

In the case of references received but not ordered, after verification that the error is not attributable to the customer the products will be returned by the customer at the expense of the seller.
The non-arrival of the Goods must be reported to the Seller within 15 days after the shipping date. 

Upon receipt of the order, the customer shall:

(a) Check that the quantity of goods received is correct;

 

(b) After laying 2 or 3 lengths on the floor, inspect the result to ensure that no defects are present. Complaints will not be accepted if several rolls have been hung with the same fault. 

(c) In the case of wallpaper that is found to be defective, the liability of the Seller is strictly limited to the invoiced value of the wallpaper and cannot under any circumstances be extended to cover any other reimbursement (labour, consumables, losses and interests ecc). All complaints must be issued by registered letter with acknowledgement of receipt within seven days of the delivery of the goods.

(d) Unwanted products must be returned in their original packaging, undamaged and in saleable condition. Once the product is received at Isidore Leroy, we will contact the customer to arrange a refund (if agreed beforehand by customers’ services).

Any problem not apparent upon reasonable initial inspection must be reported to Seller immediately after discovery. 

Shipping error 

In the case of a delivery of products not corresponding in their quantity to the purchase order, it will be sent to the customer the remainder of the order at the expense of the seller.

In the case of delivery of references different from those ordered, the products will be returned at the expense of the seller.

Damage due to transportation

Upon delivery, the customer or his representative must inspect the goods in the presence of the duly authorised carrier. In the event of damage due to transport, the customer, in his capacity as recipient, must expressly notify the reserves to be made within the time limits set with the carrier, and send a copy to the seller who reserves the right to refuse the return, refund or replacement of the products.

Guarantee of conformity

Please note minor variations are normal characteristics and are not considered a manufacturing defect. We warrant that the products we sell will at the time of delivery be free from defects in manufacturing and workmanship, other than defects that are within accepted industry norms. The customer is expected to promptly inspect the products for defects prior to installation or other processing of the products as previously specified. The Seller will not take any action on a claim unless and until the purchaser has sent the seller a written report specifying the nature of the defect. 

This warranty applies only if such defective product was subjected to normal use and for the purpose for which it was intended and if the product was properly handled, stored, installed and maintained in accordance with industry standards and/or written instructions.

In the event of non-conformity of a product sold, it may be returned to the seller who will take it back, exchange it or refund it.

No claim can be received concerning a difference in colour shade between several manufacturing baths if the buyer has placed several separate orders.

Limitation of Liability

The liability of the seller is strictly limited to the value of the goods found to be non-conforming, defective or faulty, without compensation of any kind and for any reason whatsoever.

Isidore Leroy accepts no responsibility for the misuse or misapplication of products ordered by the Customer.

Isidore Leroy is in no way responsible for the consequences resulting from : storage of products in abnormal conditions or conditions incompatible with their nature, their transformation, failure to comply with installation instructions (installation instructions are available on the website, and are in parcels), abnormal wear from poor maintenance, a choice of glue unsuitable for installation, or imperfect installation, deterioration of products due to water infiltration, impact or inappropriate use, temperature or humidity.

Protection of personal data

The seller will be able to collect information on the purchasers by using the means available on Internet, ex cookies, and to transmit if it wishes it information to its commercial partners.

However, customers may request that their personal information not be communicated and have the right to access and rectify their information.

Intellectual Property

Seller's designs, patterns and images (including photographs of room settings, images of fabrics, shades, pouches, kits and scans of patterns) are the property of Seller.

Any use of Seller's designs, patterns and images (including photographs of room settings, fabric images and pattern scans), trademarks, logos, copyright and other intellectual property rights must be authorised in writing by Seller, which may be withdrawn at any time at Seller's discretion.

Any use of the products for framing purposes or as a picture is prohibited.

Litigation

We collect personal information relating to the user (name, e-mail address, telephone number) only for the needs of the electronic transaction, for statistical processing or commercial follow-up. The user provides this information with full knowledge of the facts, especially when he/she proceeds by himself/herself to their input. The information collected is not transmitted to any third party.

The present conditions of sale online are subjected to the French law, the courts of Bordeaux are only qualified for any litigation.
